Re-Issue of Receipt Notices to Certain EAD Renewal Applicants Qualifying for EAD Auto-Extensions

Some individuals applying to renew their Employment Authorization Document (EAD) and qualifying for an automatic extension of their EADs under the Jan. 17, 2017 rule, “Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting High-Skilled Nonimmigrant Workers,” may have been issued a receipt notice (Form I-797) that does not contain an eligibility category. These notices were issued before Jan. 17, 2017.

On February 16, 2017, USCIS began re-issuing Form I-797 to individuals who applied to renew their EAD between July 21, 2016 and January 16, 2017. The re-issued Forms I-797 will contain the applicant’s eligibility category and the same “received date” as the original Form I-797. Reissuance will not change the automatic extension date of a qualifying EAD.

Applicants may present the reissued receipt notice with their expired EAD to their employer as a List A document for the Form I-9, Employment Eligibility Verification, to show that they are authorized for employment.
