I have not created a case in E-Verify for my employee whose first day of employment was more than three business days ago. May I do so now?

Yes, if you did not create a case in E-Verify within three business days after the employee’s first day of employment, you must create a case as soon as possible. E-Verify will prompt you to enter the reason for the delay. You can either select one of the reasons provided or select An Audit Revealed that New Hire was not Run.
