1.2 How to Determine Whether You are affected by the rule

The E-Verify federal contractor rule only affects federal contractors who are awarded a new contract on or after the effective date of the rule, September 8, 2009, that includes the Federal Acquisition Regulation (FAR) E-Verify clause (73 FR 67704). Some existing federal contracts may also be bilaterally modified to include the FAR E‑Verify clause after the effective date of the rule. For more information, see Section 5.3.

Your government contracting official, not the E-Verify program, determines whether your federal contract will include the FAR E-Verify clause. You should review your contract for the FAR E-Verify clause, and check with your government contracting official if you have questions.
