The prime contractor should provide general oversight to the subcontractors to ensure they meet the E-Verify requirement. The prime contractor is responsible for ensuring all subcontractors at every tier incorporate the Federal Acquisition Regulation (FAR) E-Verify Clause 52.222-54, Employment Eligibility Authorization. The prime contractor may be subject to fines and penalties if they knowingly continue to work with a subcontractor who is in violation of the E-Verify FAR requirement.
How can subcontractors provide proof of their E-Verify enrollment to the prime contractor? The subcontractor should give the prime contractor a copy of their Edit Company Profile page in E-Verify, which can be printed directly from E-Verify.
Prime contractors are not responsible for verifying their subcontractors’ individual employees.
The prime contractor must be enrolled in E-Verify as an E-Verify employer agent. This will allow the subcontractor to designate the prime contractor as their employer agent and ensure E-Verify compliance.
